Agreement to terms
These Terms of Service (“Terms”) govern your access to and use of TalkScribe's website, dashboard, public REST API, and any other TalkScribe service (collectively, the “Service”). By creating an account, using the anonymous trial, or otherwise accessing the Service, you agree to be bound by these Terms.
If you're using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. In that case, “you” refers to the organization.
If you don't agree to these Terms, don't use the Service.
The service
TalkScribe provides voice-intelligence tooling: speech-to-text transcription, AI-driven polish + summarization + structured insights, and integrations for getting that output into your workflow. Specific features available to you depend on your plan tier (Trial, Starter, Pro, or Business).
We may add, modify, or remove features over time. Material reductions in functionality on a paid plan will be communicated in advance.
Your account
To use most features, you need an account. You agree to:
- Provide accurate, current information.
- Keep your sign-in credentials secure (we use email magic-links by default; if you set a password, treat it as confidential).
- Be responsible for all activity under your account.
- Notify us promptly at hello@talkscribe.me if you suspect unauthorized access.
You must be at least 16 years old to create an account. If you create a Business workspace, members you invite are bound by these Terms upon their first use.
Plans, billing, and cancellation
Subscription plans
Paid plans (Starter, Pro, Business) are billed monthly or annually in advance. Annual billing receives a discount as displayed on the pricing page. Each plan includes a monthly usage allowance (in transcription minutes); usage above the allowance may be subject to overage fees, suspension, or both, as disclosed on the pricing page.
Payment
Payment is processed by our payment provider. By subscribing, you authorize automatic recurring charges to your payment method until you cancel. You're responsible for keeping your payment method current.
Refunds
Subscription fees are non-refundable except where required by law. We'll prorate refunds for service unavailability or material defects on a case-by-case basis.
Cancellation
You can cancel your subscription anytime from your dashboard. Cancellation takes effect at the end of the current billing period; you keep access until then.
Price changes
We may change subscription prices. We'll give you at least 30 days' notice via email before any price increase, and any change will only apply to subsequent billing periods.
Free trial
TalkScribe offers a 30-minute anonymous trial without account creation. The trial uses a one-way browser fingerprint to enforce the limit. Trial usage is subject to the same Acceptable Use rules as paid usage.
Acceptable use
You agree NOT to use the Service to:
- Transcribe content you don't have the right to transcribe (e.g., recordings of conversations where applicable consent laws require participants' permission).
- Generate, distribute, or facilitate illegal content (e.g., CSAM, non-consensual intimate imagery, content infringing intellectual property rights).
- Harass, threaten, defame, or harm others.
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except where this restriction is prohibited by law.
- Use the Service to build a competing product.
- Probe, scan, or test the vulnerability of the Service without our prior written permission (responsible-disclosure reports to hello@talkscribe.me are welcome).
- Circumvent rate limits, usage caps, or security controls.
- Create accounts using bots, scripts, or other automated means.
- Use the Service in any way that violates applicable law.
We may suspend or terminate accounts that violate these rules, with or without notice depending on the severity.
Your content
You retain all rights to the audio you upload, the transcripts produced, and any derivative artifacts (summaries, outlines, etc.) - collectively, “Your Content.”
You grant TalkScribe a limited license to process Your Content solely to provide the Service to you (transcribe audio, generate polished text, store transcripts you've chosen to save, deliver them via your configured exports + webhooks, etc.). This license terminates when you delete the content or close your account.
We do notuse Your Content to train AI models - ours or any third party's. See the Privacy Policy for details.
You're responsible for the legality of Your Content, including obtaining any consents required to transcribe recordings of others.
Our intellectual property
TalkScribe and the underlying software, design, brand, and documentation are owned by us. These Terms don't grant you any rights in our intellectual property other than the limited license to use the Service in accordance with these Terms.
You may submit feedback, suggestions, or feature requests. By doing so, you grant us a non-exclusive, worldwide, royalty-free license to use them without obligation.
Third-party services
The Service depends on third-party infrastructure (listed in our Privacy Policyas subprocessors). We're responsible for our subprocessors' compliance with our agreements with them, but we're not responsible for outages or other failures of third-party services that affect the Service.
If you connect TalkScribe to third-party tools (e.g., via API keys or webhooks), your use of those tools is governed by their own terms.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
Transcription is performed by AI models and is not perfect. We make no warranty about the accuracy, completeness, or suitability of transcripts or AI-generated artifacts. You shouldn't rely on TalkScribe output for life-critical or high-stakes decisions without human review.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALKSCRIBE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $100.
Some jurisdictions don't allow these limitations. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify and hold TalkScribe harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from (a) your violation of these Terms, (b) your violation of any third-party rights, including intellectual property or privacy rights, or (c) Your Content.
Termination
You may close your account at any time from the dashboard or by contacting hello@talkscribe.me.
We may suspend or terminate your account if you breach these Terms, if your use of the Service poses a legal or security risk to us or others, or as required by law. We'll give you reasonable notice where practical.
On termination, your right to use the Service ends immediately. Sections that should survive termination by their nature (e.g., intellectual property, disclaimers, limitation of liability, indemnification, governing law) will continue to apply.
Changes to these terms
We may modify these Terms over time. Material changes will be announced via email to active account holders and via a notice on the homepage at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
If you don't agree to a change, your remedy is to stop using the Service and close your account.
Governing law and disputes
These Terms are governed by the laws of [JURISDICTION TO BE DETERMINED - placeholder pending legal review], without regard to conflict-of-laws principles. The exclusive venue for any dispute arising under these Terms is the state and federal courts located in that jurisdiction.
